theBreaker.news reporter Bob Mackin reported on October 7, 2026 that Lina Vargas, an ABC Vancouver candidate for School Board, posted an Instagram video that shows her talking on camera while behind the wheel of a moving vehicle.

The report says a motion detection prompt from an onboard device is visible during the recording. Mackin writes that the footage appears to show behaviour that would attract a $368 fine and four penalty points under BC's distracted driving law. Those figures come from the theBreaker.news article; this site has not independently verified the current fine schedule.

Neither Vargas nor anyone from the ABC Vancouver campaign responded to theBreaker.news before publication, according to the article. ICBC is quoted in the report saying that "anything that takes your attention away from driving can contribute to distracted driving."

The report notes that [Sarah Kirby-Yung](/candidates/sarah-kirby-yung), Deputy Mayor and ABC Vancouver candidate for City Council, similarly spoke while driving during a December 11, 2024 committee meeting. The article presents this as background context; no suggestion of a charge against Kirby-Yung appears in the report.

No police charge against Vargas has been reported. The theBreaker.news article describes what the video appears to show; it does not report that a charge has been laid or that police have been contacted.

Lina Vargas is running for Vancouver School Board under ABC Vancouver. Her biography, as described by theBreaker.news, says she is the founding president of the Diversity and Inclusion Support Group of B.C.
